Resolution 2018-3 At a public meeting on January 28, 2018, the Board voted 2 to 1 to adopt Resolution 2018-3, which authorized a Declaration of Taking for the purpose of exercising the right of Eminent Domain for the Mount Valley Riders Saddle Club property to be added to the Municipal Park complex. This right was exercised on May 22, 2018 after negotiations with the Saddle Club were unsuccessful and the Club announced sale of the property. The Township received full possession of the property on August 6, 2018; however, the Township participated in a Court Hearing on September 24, 2018 to hear objections raised by the Saddle Club's attorney. On October 17, 2018, the Court overruled those objections and scheduled a new hearing for November 20, 2018; whereupon the Court ruled that the newly named Silver Star Saddle Club in Greencastle should receive the estimated just compensation of $32,000. A Board of View held a hearing on April 29, 2019 and decided on May 30 that the compensation be increased to $55,000. The Saddle Club's attorney filed for interest on the compensation and a court hearing was held on January 11, 2019; whereupon that request was denied on January 25, 2019. On February 25, 2019 the Saddle Club's attorney filed an appeal with the Commonwealth Court for interest and subpoena of documents and again on July 19, 2019 filed an appeal with the Court of Common Pleas for a jury trial. In order to avoid additional legal fees, which could far exceed $10K, the Township offered to settle the compensation issue with the Saddle Club, and the offer of $65,000 was accepted on February 10, 2020.
